I have been watching some replays from the gamesreplays tournaments, and i havnt seen tempest being picked nor banned yet. I couldnt find anything in the rules which suggested that he was auto banned, why is he suddently low tier Oo?
because there are alot of tempest counters, essentially any hero that can stun.
He was beyond top tier, a couple of weeks ago

Sand Wraith and Vindicator ultimates counter portal key initiations. Panda has 3 disables that all go through Shrunken Head.
HoN has a type of play where the metagame can change even without heroes themselves being directly changed. People have capable Pharaohs on their lineup which counter Tempest pre-BKB, Soul Reaper and Succubus are popular picks who both counter Tempest even with BKB... etc.
Hellbringer is the only true Tempest counter honestly. Rest are hit and miss.

Hit and miss. Fights can and do last longer than 5 seconds, especially considering a decent team will backpedal until the silence is over before engaging again...where Tempest blinks in. I would admit that Sand Wraith is probably nearly as good as Hellbringer at shutting down Tempest though!
Tempest is still top tier. He is almost always banned, and when he isn't its usually because Hellbringer/Wraith wasn't either.

Vindi could wait and use his ulti when tempest does, actually making him a global counter, compared to a 1200 yard counter by hellbringer
Vindicator can sit back and silence when tempest ults, countering it completely.
Hellbringer, pharoah, vindicator, demented shaman, magmus, there are just too many, alsot you can have sandwraith ult, or thunderbringer ult so he cant blink.

they made a nasty hero to counter tempest : vindicator.
germans are from germany.
Vindicator, Hellbringer, Sand Wraith, Thunderbringer quite easily counters tempest.. and high tier teams knows how position themselves without being all caught in the tempest ulti.
Silencer and Spectre got ported. ^^
wait wait.. so if a hero has counters he is useless? i mean he still has a decent stun and awesome pushing power.
Since he's actually picked in dota (viz EG vs. KS.int), he's perfectly pickable, it's just that teams won't necessarily choose to do it every game.
what about sandwraith counters tempest's ult? i'm missing something.

yes, the sandwraith counter assumes a tempest that blinks and ults. the sandwraith images will counter this by deactivating the portal key and revealing tempest's hiding spot.
